TERMS OF USE AGREEMENT The Disciplined Trader Telegram Channel 1. PURPOSE & REGULATORY STATUS These Terms of Use set out the basis on which Marvin Christians ("the Representative") provides trading strategies, educational content, and market commentary to members of "The Disciplined Trader" Telegram Channel ("the Member"). By joining or remaining a member of "The Disciplined Trader" Telegram Channel, you agree to be bound by these terms. The Representative is a duly authorised representative (FSP number: [insert]), operating under the supervision and licence of Asher Global Group (Pty) Ltd ("the FSP"), FSP number 54565, authorised under the Financial Advisory and Intermediary Services Act, 37 of 2002 ("FAIS Act"). The Representative does not operate as an independent FSP. 2. YOUR RELATIONSHIP WITH HF MARKETS Membership of "The Disciplined Trader" Telegram Channel is available exclusively to individuals who hold an active live trading account with HF Markets ("HFM") registered under the Representative's Introducing Broker ("IB") number. It is important that Members understand the following: - You are a client of HFM, not of the Representative. Your trading account is opened directly with HFM, and all trading activity takes place on HFM's platform. - HFM's own terms and conditions govern your trading account, deposits, withdrawals, and execution of trades. The Representative has no control over, or responsibility for, any of these. - The Representative's sole role within the channel is to share trading strategies, educational material, and market insights. Membership does not constitute a financial advisory, asset management, or brokerage relationship with the Representative. - The Representative acts as an Introducing Broker to HFM and may receive rebates or commissions based on Member trading activity. This does not increase your trading costs beyond HFM's standard pricing, and by accepting these terms you consent to this arrangement. - The Representative does not hold, manage, or have access to Member funds at any time. - The Representative reserves the right to verify account status and may remove access for any Member who does not maintain an active qualifying HFM account. 3. RISK DISCLOSURE Forex and leveraged derivative trading carries a high level of risk and is not suitable for everyone. Please make sure you fully understand what you are getting into before trading. By accepting these terms, you acknowledge that: - Forex trading is speculative and you may lose more than you deposit. - Leverage amplifies both gains and losses significantly. - You may be subject to margin calls requiring additional funds at short notice. - Market conditions can change rapidly and without warning. - You are trading based on your own decision, having considered your personal financial circumstances, and you will seek independent financial advice if needed. 4. NO GUARANTEES OR REPRESENTATIONS Everything shared in "The Disciplined Trader" Telegram Channel, including trade ideas, signals, commentary, and educational content, is provided for informational and educational purposes only. The Representative makes no representation, warranty or guarantee that: - Any trade idea or signal will be profitable. - Losses will not occur. - Published or historical results will be repeated in future. - Signals will be accurate, complete, or delivered on time. - Any projected or illustrative performance reflects what you will actually achieve. - Past performance is not indicative of future results. 5. LIMITATION OF LIABILITY The Representative's responsibility is strictly limited to the educational and informational content shared within the channel. To the fullest extent permitted by law, the Representative and the FSP will not be liable for any losses or damages you suffer in connection with: - Trading losses, margin calls, slippage, or platform downtime. - Errors, delays, or failures on the part of HFM. - Spread widening, withdrawal delays, system failures, or any other market or execution event outside the Representative's control. All execution-related matters are the sole responsibility of HFM. Any issues relating to your trading account, platform, or fund management must be taken up directly with HFM. Nothing in these terms excludes liability where doing so is prohibited by law. 6. YOUR RESPONSIBILITIES AS A MEMBER By joining "The Disciplined Trader" Telegram Channel, you confirm that you: - Understand that all trading decisions are yours alone — signals and commentary are not instructions to trade. - Will apply your own risk management and not over-expose your account. - Understand leverage and position sizing before placing trades. - Will not trade with funds you cannot afford to lose. - Will actively monitor your own trading account. 7. CONFIDENTIALITY All content shared in "The Disciplined Trader" Telegram Channel, including strategies, signals, and educational material remains the intellectual property of the Representative. Members may not copy, share, redistribute, or publish any content outside of the channel without prior written consent. 8. TERMINATION The Representative may remove a Member's access to "The Disciplined Trader" Telegram Channel at any time, at his discretion.
